A New York mother who was arrested after she refused to send her son to Arizona to visit his incarcerated father was released Tuesday.

Sukhwant Herb, 30, was arrested on a warrant June 10 after failing to appear in court five times since January and failing to comply with an existing court order she had consented to, said David Bookstaver, spokesman for the New York state Office of Court Administration.

The father, Seon Delon Jonas, 30, was convicted of three counts of sexual assault and sentenced to 27 years at the Arizona Department of Corrections.

Herb, who has full custody of her 9-year-old son, had agreed to send him to visit his father in prison twice a year. But she changed her mind because she didn't feel it was a healthy environment for her son, her lawyer, Dale Frederick, said.

"She also has some concerns that her son may get the wrong impression that being in jail and going there is acceptable," Frederick said.

Brooklyn Family Court Judge Robin Sheares ordered 50 days in jail without bond. It is still unclear why bail was not posted, Bookstaver said. Herb was called back to court Tuesday and released without bail. Bookstaver said incarceration is a last resort in comparable situations.

Herb was not available for comment.
